3. Information guide in terms of Section 10 of The Act and the availability of this manual

A Guide has been compiled by The Human Rights Commission in terms of Section 10 of PAIA . It contains information required by a person wishing to exercise any right, contemplated by PAIA.

Any person who wishes to exercise any right contemplated in The Act may obtain a copy of the information guide issued by the Human Rights Commission in all official languages, from the Human Rights Commission, tel (011) 887-3600.

Alternatively, The Guide is available for inspection, inter alia, at the office of The Human Rights Commission at 29 Prince of Wales Terrace, Cnr York and St Andrews Street, Parktown and on its website at www.sahrc.org.za.

4. Detail on how to make a request for access to information - Section 52(e)

Information which is not readily available as indicated in this manual, may be requested in accordance with the procedure prescribed in terms of the Act. Copies of the prescribed forms to be completed for submitting a request, are available from NewMusicSA or they can be accessed on www.sahrc.co.za.

The requester must complete Form C and submit this form together with a request fee, to the head of the private body.

The completed form must be sent to the address, fax number or e-mail address provided in this manual and marked for the attention of the Information Officer.

The form must:

  • provide sufficient particulars to enable the head of the private body to identity the record/s requested and to identity the requester, indicate which form of access is required,
  • specify a postal address or fax number of the requester in the Republic,
  • identify the right that the requester is seeking to exercise orprotect, and provide an explanation of why the requested record is required for the exercise or protection of the right,
  • if inaddition to a written reply, the requester wishes to be informed of the decision on the request in any other manner, to state manner and the necessary particulars to be informed in the other manner,
  • if the request is made on behalf of another person, to submit proof of the capacity in which the requester is making the request, to the reasonable satisfaction of the head of the private body.
